Piraeus e-banking Services (internet, phone, mobile, alert) - Terms and Conditions of Use

 The following terms and conditions shall in no case substitute for the agreement signed by each Piraeus e-banking services subscriber which governs such subscriber’s dealings with Piraeus Bank S.A. (hereinafter referred to as "The Bank"). The Bank reserves the right to revoke or amend the terms of use for the services offered through Piraeus e-banking (hereinafter referred to as "the Services"), the provision of which by the Bank shall not be compulsory.

 
1. The Bank shall not provide the devices required for access to the Services and the subscriber shall undertake the cost of use of such devices as well as any associated expenses or taxes.

 
2. Applying subscribers shall have to keep at least one account with the Bank and fill in the relevant application form to start receiving the Services. Such application may be filled in and sent either electronically through the Internet or through the Bank’s Call Centre by calling at +30 210 32 88000. Alternatively, applicants may visit one of the Bank’s branches and directly sign the Agreement on the provision of Access to the Piraeus e-banking System (hereinafter referred to as "the Agreement").

 
3. Provided the said application is approved, the applicant shall be invited to sign the Agreement. The Agreement term shall be indefinite. The Personal Identification Code (PIN) for access to the Services shall subsequently be sent to the applicant or the latter shall collect the PIN from one of the Bank’s branches. The Bank shall provide the subscriber with the ability to change the PIN according to his/her requirements while, immediately upon first access to the Services, the subscriber shall have to change the initial PIN to another PIN, to which the Bank shall have no access whatsoever.

 
4. Since the system identifies the subscriber from the PIN entered when logging on to the Services, it is the subscriber’s responsibility to ensure the secrecy of his/her access codes. The subscriber should in no case disclose his/her codes to any third party. The subscriber shall be solely responsible and shall undertake the risk for any damage incurred by him/her or the Bank due to any access by a third party to the subscriber’s access codes.

 
5. Should the subscriber become aware in any case that his/her access codes have leaked out, he/she shall have to immediately inform the Bank by calling at +30 210 32 88000, so as to immediately cancel the codes. Any failure to notify the Bank shall constitute severe negligence on behalf of the subscriber and shall release the Bank from any liability against the subscriber for damages caused by amounts charged with the use of the subscriber's access codes prior to the Bank's notification on the leakage or loss / theft of his/her codes. In addition, the subscriber shall have to promptly notify the Bank (following the procedure specified in the Agreement) in case the authorisation of subscriber's representative carrying out transactions in the name and on behalf of the subscriber has been lifted.

 
6. The Bank undertakes the responsibility to properly and timely carry out the subscriber's transmitted orders upon their receipt by the Bank's systems and according to the subscriber’s execution instructions. In the case of an order for a deferred or regular payment whereby the payment date is a holiday, such payment shall be carried out on the next business day according to the Bank’s calendar of business days. Moreover, payment orders received after 16.00 on the specified payment date shall be carried out on the next business day (with the exception of transfers within Piraeus Bank).

 
7. The Bank cannot assume any responsibility for problems in the operation of the underlying telecommunications network which fall beyond its authority or control and may have a negative impact on the correct and timely execution of transmitted orders. The subscriber shall have no access to the Services in case of telecommunication failures and/or events of force majeure and in any case the Bank does not guarantee to the subscriber uninterrupted access to the Services. When it is not feasible to use a Service, the subscriber may use alternative channels for access to the Bank.

 
8. The subscriber does not have the right to revoke or amend any order transmitted to the Bank with the use of his/her access codes when such order has already been executed, unless this is provided for by the Banking practice and is feasible, subject to a fee charged to the subscriber for such amendment or revocation.

 
9. The Bank may in certain cases not execute subscriber's orders. Such refused execution shall be documented (e.g. insufficient balance to execute subscriber’s orders, account blocking following a decision of a court or other authority, confirmed inaccurate and mistaken information).

 
10. All money transfers carried out through the Services shall be listed with special reference on the bank statements issued by the Bank. Such statements are true copies of the Bank's books. The subscriber acknowledges the proving power of the books kept by the Bank as regards transactions carried out through Piraeus e-banking.

 
11. The printout of a transaction's details is indicative and does not prove the transaction execution date and time or the full transaction details, while such printout is provided only for subscriber information purposes. The Bank’s books are the only proof of any transaction, as specified in the previous term.

 
12. A participation in a Share Capital Increase organised by a societe anonyme shall apply only to Share Capital Increases carried out through an Initial Public Offering (IPO). Applications shall be accepted by noon (12.00) of the subscription deadline, as announced by the Bank.

 
13. The use by the subscriber of mnemonic names to describe banking products, specified payment recipients, credit card numbers etc. are intended for own use by the subscriber and is offered only to facilitate the use and memorising by the subscriber. Mnemonic names used by the subscriber are indicative and are not binding for the Bank, while only the data corresponding to such mnemonic description on the date and time when a relevant transaction is sent to the Bank shall be considered valid.

 
14. Certain banking transactions and services offered through Piraeus e-banking are charged with bank fees and expenses, which is also the case when carrying out such transactions in the traditional manner. The Bank reserves its right to charge subscribers with such fees and expenses according to its applicable Pricing Policy which is notified to subscribers through the Services access channels. In case a subscriber does not agree with such charges, he/she shall have the right to discontinue his/her subscription without any further financial charge or consequence. The initial issuing of access codes is charged 5.00 Euros including VAT.

 
15. The Bank reserves to right to extend or limit, in its free judgement, the type, amount or number of transactions and offered Services in general, and also to determine the days, times and duration for the operation of such Services.

 
16. Orders transferred to the Bank through the Services are acknowledged as being irrevocable in the meaning specified in the Civil Code, article 724, item 2. Such orders and the authority granted through them shall survive the death or, as the case may be, the court prohibition, dissolution or bankruptcy of the Client according to articles 223 and 726 of the Civil Code.

 
17. The use of cookies through the Internet is intended to record the interest of subscribers in the Bank’s products and services. This helps compile and analyse data relating to web page traffic and also meet subscriber needs. Therefore, in this case the said information are compiled solely for statistical reasons. In case, however, a subscriber rejects such a cookie (by selecting the necessary settings in his/her browser), his/her access shall not be blocked. The Bank’s intention is to assure subscribers that by accepting a cookie the Bank gains no access to their computer or personal data, except those that they chose to share with the Bank.

 
18. It is strictly prohibited to copy, distribute, dispatch or broadcast with electronic or other means, adapt or adjust and circulate or present to the public any material incorporated in the Services without the Bank’s prior written permission. Such material is and shall remain intellectual property of the Bank.
 
19. Links to the websites of third parties
The Bank of Piraeus website allows its users the opportunity to move via special connections (links, hyperlinks, banners) to the websites of third parties, design of the content of which is entirely the responsibility of these parties. The Bank of Piraeus cannot guarantee the availability of these linked sites and does not approve or accept liability for the content, correctness, legality, fullness, actuality or accuracy of the information, or the quality and properties of the products and services offered to the public by these parties through the aforesaid websites. The Bank of Piraeus accepts no liability for errors or operating faults in the websites of third parties, nor for any loss sustained by users from access to these sites or from use of the information, services and products available on these sites.
 
 
 


 BANKING SECRECY-PERSONAL DATA

 
1. The Bank has adopted all necessary measures to ensure security in the provision of the offered Services and maintain the secrecy of information relating to subscribers. However, subscribers shall also have to handle all information provided through the Services as confidential and secret, and to refrain from disclosing such information to any third party.

 
2. The Customer has been informed that any personal data which are contained herein, or which have been or will be lawfully received by the Bank in the future in respect of this Agreement, will be included in the personal data file which is held by the Bank (Controller), and will be processed in order to properly serve, support and monitor the Customer’s business relation, as indicated in the information brochure entitled “Data Privacy Notice”; it is hereby affirmed that the Customer received it, has been informed of its content and said brochure is an integral part hereof. All the above apply to the Bank’s current clients, as well as to persons applying for any service, irrespective of whether their application has been successfully processed or not. In case any of the above terms is substantially amended, the Bank shall promptly inform its clients and the visitors of its website through announcements on such site.
